A practical checklist that prevents disputes
Property transfers can be smooth when the checklist is followed from day one.
Here are the most common items that cause delays — and how to avoid them.
1) Confirm ownership and conduct searches
- Official search at the relevant registry.
- Check restrictions, caveats, charges, encumbrances.
- Verify seller authority (company resolutions / power of attorney where applicable).
2) Sale Agreement must be clear
- Deposit terms, completion timelines, and conditions precedent.
- Completion documents list (title, consents, clearances).
- Default clauses (what happens if either side delays).
3) Completion documents
Ensure clearances and consents are planned early (rates/rent, land control/consents where required),
and confirm the transfer instrument is properly prepared.
4) Stamp duty and registration
Stamp duty assessment, payment and stamping are required before registration.
After registration, confirm title issuance and collect certified copies for your records.
5) Post-completion
- Handover, vacant possession, utilities changes.
- Keep the complete closing file and proof of registration.
